VolumnBooster Terms of Service

Welcome to VolumnBooster! These Terms of Service ("Terms") govern your access to and use of the VolumnBooster macOS application ("App") provided by Dreammers Studio ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using VolumnBooster, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

VolumnBooster is an audio controller utility for macOS. It offers output audio device switching, system volume controls, audio amplification (boosting system output up to 400% / +12 dB), and independent volume control for individual active applications (per-app mixing).

Some features are free, while others are designated as **Premium** (such as volume boosting past 120% and per-app volume adjustments) and require a paid in-app subscription or lifetime purchase. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time.

3. Audio and Hearing Safety Warning

⚠️ CRITICAL SAFETY NOTICE: VolumnBooster is capable of amplifying audio signal levels significantly beyond standard macOS limits. Listening to highly amplified sound or sudden volume bursts can lead to permanent hearing damage, hearing loss, or tinnitus. Furthermore, excessive amplification levels can damage physical audio hardware, including internal Mac speakers, external speakers, and headphones.

By using this App, you expressly agree that:

• You use VolumnBooster at your own sole risk.
• You are entirely responsible for monitoring volume levels and preventing exposure to unsafe levels of sound.
• Dreammers Studio shall not be liable for any hearing damage, hearing loss, hardware damage, or other physical injury resulting from your use of the App.

4. Subscriptions and In-App Purchases

VolumnBooster offers Premium features through subscriptions (monthly or yearly) or a one-time lifetime purchase.

• Billing: Purchases are billed and processed through Apple's App Store payment processor.
• Automatic Renewal: Subscriptions automatically renew unless cancelled in your App Store settings at least 24 hours before the end of the current billing cycle.
• Refunds: Refunds are handled exclusively by Apple. You can request refunds via Apple's "Report a Problem" platform.
• Pricing Changes: We reserve the right to adjust package pricing. Price adjustments will be updated through the App Store and communicated prior to renewal.

5. Your Data & Content

Your application volume preferences, settings, and local custom configurations are stored exclusively on your physical device. We do not store or backup this data on our servers. Uninstalling the App will delete all such preferences permanently.

6. Intellectual Property

The App, including its visual design, assets, audio engine source code, user interface, and branding, is owned by Dreammers Studio and is protected by copyright, trademark, and intellectual property laws. You may not copy, modify, distribute, reverse engineer, decompile, or create derivative works of the App without our express prior written permission.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE AUDIO QUALITY WILL ALWAYS BE DISTORTION-FREE, OR THAT THE APP WILL OPERATE UNINTERRUPTED OR COMPLETELY BUG-FREE. AUDIO DRIVERS AND macOS API BEHAVIOR MAY CHANGE WITH OPERATING SYSTEM UPDATES, AND THE APP'S COMPATIBILITY MAY BE AFFECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DREAMMERS STUDIO, ITS DEVELOPERS, OR ITS ASSOCIATES BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR HEARING DAMAGE, LOSS OF HEARING, HARDWARE REPAIR COSTS, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be marked by updating the "Last Updated" date at the top of the Terms page. Continued usage of the App indicates your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dreammers Studio operates, without regard to its conflict of law principles.
